L Liberalisasi perdagangan dalam kerangka wto menimbulkan risiko lonjakan impor yang dapat mengancam industri dalam negeri. pasal xix gatt 1994 dan agreement on safeguards (aos) menyediakan instrumen safeguard sebagai escape clause bagi negara anggota untuk membatasi impor sementara. indonesia dan vietnam, sesama negara berkembang anggota wto yang pernah menerapkan safeguard atas produk baja, mengadopsi ketentuan tersebut dengan arsitektur regulasi dan kelembagaan berbeda. permasalahan yang dikaji adalah persamaan dan perbedaan pengaturan safeguard indonesia dan vietnam serta penerapannya pada kasus produk baja di kedua negara. penelitian menggunakan metode hukum normatif dengan pendekatan perbandingan hukum, bersumber pada bahan hukum primer dan sekunder. hasil analisis menunjukkan indonesia membangun kerangka safeguard dalam tiga lapisan norma dengan kewenangan terpisah kppi dan menteri keuangan, sedangkan vietnam mengkonsolidasikannya dalam satu undang-undang dengan trav sebagai otoritas penyelidik di bawah moit. perbedaan mendasar terletak pada mekanisme kelembagaan, cakupan tindakan, dan anti-circumvention yang tidak dikenal dalam sistem indonesia. studi kasus baja menunjukkan vietnam menerapkan keputusan terdiferensiasi per sub-produk sesuai pasal 5.1 aos, sementara indonesia menerapkan perlindungan seragam. sistem vietnam lebih adaptif, namun indonesia memiliki kepastian hukum lebih kuat melalui pmk.
( (e) trade liberalisation within the framework of the world trade organization (wto) creates a risk of import surges that may threaten domestic industries. article xix of the general agreement on tariffs and trade 1994 and the agreement on safeguards (aos) provide safeguard measures as an escape clause that allows wto members to temporarily restrict imports under specified conditions. indonesia and vietnam are developing-country members of the wto that have both imposed safeguard measures on steel products, but have incorporated the relevant wto rules into different regulatory and institutional frameworks. this research examines the similarities and differences between the safeguard regulations of indonesia and vietnam and analyses their application in steel safeguard cases in both countries. it employs normative legal research using a comparative-law approach and relies on primary and secondary legal materials. the findings demonstrate that indonesia regulates safeguard measures through a three-tier regulatory framework, in which the investigative function is exercised by the indonesian trade safeguards committee (kppi), while safeguard duties are formally imposed through regulations issued by the minister of finance. by contrast, vietnam consolidates the principal rules governing trade remedies in the law on foreign trade management no. 05/2017/qh14, with the trade remedies authority of vietnam (trav) acting as the investigating authority under the ministry of industry and trade (moit). the principal differences concern institutional arrangements, the scope and application of safeguard measures, and the availability of an anti-circumvention mechanism, which is not specifically regulated within indonesia’s safeguard regime. the steel case studies further demonstrate that vietnam adopted differentiated treatment for different product subcategories, reflecting the proportionality requirement under article 5.1 of the aos, whereas indonesia applied a uniform safeguard measure to the products covered by its investigation. vietnam’s system therefore demonstrates greater flexibility and adaptability, while indonesia places greater emphasis on formal legal certainty through minister of finance regulations.
