P Penarikan amerika serikat dari paris agreement 2015 melalui executive order no. 14162 dan penghentian keikutsertaannya dalam green climate fund (gcf) menimbulkan persoalan hukum dan finansial bagi pendanaan iklim global, khususnya bagi indonesia yang bergantung pada pendanaan internasional untuk mencapai target nationally determined contributions (ndc). penelitian normatif-kualitatif ini menganalisis akibat hukum penarikan diri tersebut terhadap kewajiban pendanaan negara maju melalui gcf serta dampaknya bagi indonesia. hasil penelitian menunjukkan penarikan diri tersebut mengakhiri keterikatan traktual amerika serikat, tetapi tidak menghapus tanggung jawabnya yang bersumber dari unfccc dan prinsip common but differentiated responsibility respective capabilities (cbdr-rc), sehingga dapat dibaca sebagai non-compliance terhadap rezim perubahan iklim internasional. dampaknya bagi indonesia tidak langsung namun signifikan: hak akses terhadap gcf tidak berubah, tetapi hilangnya kontribusi amerika serikat memperketat kapasitas mobilisasi dana gcf di tengah besarnya kebutuhan pembiayaan iklim indonesia, sehingga diperlukan penguatan kerangka hukum nasional, diversifikasi instrumen pembiayaan domestik, dan peningkatan kapasitas kelembagaan agar target ndc tetap tercapai.
T The united states’ withdrawal from the 2015 paris agreement via executive order no. 14162 and the termination of its participation in the green climate fund (gcf) have raised legal and financial issues for global climate finance, particularly for indonesia, which relies on international funding to achieve its nationally determined contributions (ndc) targets. this normative-qualitative study analyzes the legal consequences of this withdrawal on developed countries’ funding obligations through the gcf, as well as its impact on indonesia. the findings indicate that the withdrawal terminates the united states’ treaty-based obligations but does not eliminate its responsibilities stemming from the unfccc and the principle of “common but differentiated responsibilities and respective capabilities†(cbdr-rc), and thus can be interpreted as non-compliance with the international climate change regime. the impact on indonesia is indirect but significant: access to the gcf remains unchanged, but the loss of u.s. contributions constrains the gcf’s capacity to mobilize funds amid indonesia’s substantial climate financing needs. consequently, strengthening the national legal framework, diversifying domestic financing instruments, and enhancing institutional capacity are necessary to ensure that ndc targets are met.
