M Menganalisis prosedur pemberhentian aparatur sipil negara (asn) darijabatan pimpinan tinggi pratama serta mengkaji adanyapenyalahgunaan kewenangan oleh gubernur maluku dalam penerbitankeputusan gubernur maluku nomor 2354 tahun 2023 tentangpemberhentian staf ahli gubernur. didasarkan pada dugaan tidakdipatuhinya ketentuan hukum yang mengatur pemberhentian asn yangseharusnya dilaksanakan berdasarkan prinsip sistem merit dan asas-asas umum pemerintahan yang baik. permasalahan yaitu kesesuaianprosedur pemberhentian asn dengan peraturan perundang-undangandan bentuk penyalahgunaan kewenangan oleh gubernur maluku selakupejabat pembina kepegawaian. metode penelitian yang digunakanadalah yuridis normatif dengan pendekatan perundang-undangan,konseptual, dan pendekatan kasus melalui analisis putusan nomor8/g/2024/ptun.abn. hasil penelitian menunjukkan bahwapemberhentian drs. semuel estefanus huwae, m.h., tidak sesuaidengan ketentuan hukum yang berlaku karena tidak didahului evaluasikinerja selama enam bulan dan uji kompetensi kembali sebagaimanadiwajibkan oleh peraturan perundang-undangan. tindakan tersebutdikualifikasikan sebagai penyalahgunaan wewenang dalambentuk detournement de pouvoir serta melanggar asas-asas umumpemerintahan yang baik, khususnya asas kecermatan dan kepastianhukum. penelitian ini menegaskan bahwa diskresi pejabat pembinakepegawaian memiliki batasan hukum yang wajib dipatuhi untukmenjamin profesionalisme dan objektivitas manajemen asn.
T This study analyzes the procedures for dismissing state civil apparatus (asn) from primary high leadership positions and examines the abuse of authority by the governor of maluku in issuing maluku governor\\\'s decree number 2354 of 2023 concerning the dismissal of the governor\\\'s expert staff. this study is based on allegations of non-compliance with legal provisions governing the dismissal of asn, which should be implemented based on the merit system and the general principles of good governance. the issues are the compliance of the asn dismissal procedures with statutory regulations and the abuse of authority by the governor of maluku as the personnel development officer. the research method used is normative juridical with a statutory approach, conceptual, and case approach through an analysis of decision number 8/g/2024/ptun.abn. the results of the study indicate that the dismissal of drs. the dismissal of dr. samuel estefanus huwae, m.h., did not comply with applicable legal provisions because it was not preceded by a six-month performance evaluation and a re-competency test, as required by law. this action is classified as an abuse of authority in the form of a detournement de pouvoir and violates the general principles of good governance, particularly the principles of accuracy and legal certainty. this research confirms that the discretion of the civil service supervisory officer has legal limits that must be adhered to to ensure the professionalism and objectivity of civil servant management.
