K Koperasi merupakan badan usaha strategis yang keberlanjutannya sangat bergantung pada kepastian hukum dalam penyelesaian persoalan kepailitan. ketiadaan pengaturan eksplisit dalam uu kepailitan mengenai pihak yang berwenang mengajukan permohonan pailit terhadap koperasi menimbulkan permasalahan hukum, yakni bagaimana kewenangan pihak yang mengajukan permohonan pailit koperasi pada putusan nomor 25/pdt.sus-pailit/2024/pn niaga jkt pst ditinjau dari uu kepailitan dan sema nomor 1 tahun 2022? dan bagaimana proses putusan dikabulkannya permohonan pailit koperasi oleh pengadilan pada putusan nomor 25/pdt.sus-pailit/2024/pn niaga jkt pst ditinjau dari uu kepailitan dan sema nomor 1 tahun 2022? penelitian ini bertujuan menggambarkan kewenangan pihak yang mengajukan permohonan pailit koperasi dan analisis dikabulkannya putusan nomor 25/pdt.sus-pailit/2024/pn niaga jkt pst ditinjau dari uu kepailitan dan sema nomor 1 tahun 2022. metode penelitian yang digunakan penelitian hukum normatif dengan sifat deskriptif dan data sekunder yang dikuatkan hasil wawancara. menyatakan kewenangan pengajuan permohonan pailit terhadap koperasi tidak diatur dalam uu kepailitan, namun diatur sema nomor 1 tahun 2022 yaitu koperasi simpan pinjam hanya dapat dimohonkan oleh menteri koperasi dan koperasi lkm diajukan ojk. putusan nomor 25/pdt.sus-pailit/2024/pn niaga jkt pst tidak mencerminkan kepatuhan terhadap sema karena permohonan tidak dimohonkan menteri koperasi. putusan nomor 25/pdt.sus-pailit/2024/pn niaga jkt pst menunjukkan kekeliruan hakim karena mengabulkan permohonan pailit koperasi yang dimohonkan pengurus tanpa kewenangan sah dikarenakan pengurus tidak memenuhi syarat legal standing. hakim pengadilan niaga dan pihak koperasi wajib mematuhi sema nomor 1 tahun 2022 dengan memastikan kewenangan, legal standing, dan mekanisme internal agar permohonan pailit tidak menimbulkan kesalahan penerapan hukum.
C Cooperatives are strategic business entities whose sustainability is highly dependent on legal certainty in resolving bankruptcy issues. the absence of explicit regulations in the bankruptcy law regarding the parties authorized to file a bankruptcy petition against cooperatives raises legal issues, namely: what is the authority of the party filing the bankruptcy petition for the cooperative in decision number 25/pdt.sus-pailit/2024/pn niaga jkt pst reviewed from the bankruptcy law and sema number 1 of 2022? and how is the decision process for granting the cooperative\'s bankruptcy petition by the court in decision number 25/pdt.sus-pailit/2024/pn niaga jkt pst reviewed from the bankruptcy law and sema number 1 of 2022? this study aims to describe the authority of the party filing a bankruptcy petition for the cooperative and the analysis of the granting of decision number 25/pdt.sus-pailit/2024/pn niaga jkt pst in terms of the bankruptcy law and sema number 1 of 2022. the research method used is normative legal research with a descriptive nature and secondary data strengthened by the results of interviews. stating that the authority to file a bankruptcy petition for cooperatives is not regulated in the bankruptcy law, but is regulated by sema number 1 of 2022, namely that savings and loan cooperatives can only be submitted by the minister of cooperatives and lkm cooperatives are submitted by the ojk. decision number 25/pdt.sus-pailit/2024/pn niaga jkt pst does not reflect compliance with sema because the petition was not submitted by the minister of cooperatives. decision number 25/pdt.sus-pailit/2024/pn niaga jkt pst demonstrates the judge\'s error in granting the cooperative\'s bankruptcy petition filed by the management without legal authority because the management did not meet the legal standing requirements. the commercial court judge and the cooperative are required to comply with circular letter number 1 of 2022 by ensuring their authority, legal standing, and internal mechanisms to ensure that the bankruptcy petition does not result in errors in the application of the law.
