P Penelitian ini membandingkan kewenangan presiden dalam pengesahan rancangan undang undang (ruu) di indonesia dan amerika serikat untuk mengidentifikasi persamaan dan perbedaan serta relevansinya bagi penguatan ketatanegaraan indonesia, dengan metode hukum normatif berpendekatan perbandingan (deskriptif-komparatif) berbasis bahan hukum sekunder. hasilnya, presiden di kedua negara sama-sama berperan pada tahap akhir pembentukan undang-undang, namun di indonesia presiden menjadi mitra dewan perwakilan rakyat sejak pembahasan tanpa veto pasca-persetujuan bersama (ruu tetap sah meski tidak ditandatangani 30 hari), sedangkan di as presiden memiliki kontrol akhir melalui regular veto dan pocket veto dengan kemungkinan override untuk regular veto oleh kongres. perbedaan ini menegaskan model checks and balances yang berbeda, as melalui veto dan override, indonesia melalui persetujuan bersama dan judicial review mahkamah konstitusi. relevansinya, untuk memperkuat koreksi pada fase akhir legislasi secara parsial (sebagian) berupa pasal dan atau ayat tertentu yang dinilai bertentangan dengan kebijakan dan urgensi nasional, penelitian ini mengusulkan penguatan hak korektif terbatas (limited veto) bagi presiden, pre-enactment constitutional review, serta perbaikan kualitas proses pembentukan undang-undang.
T This study compares the president’s authority in the ratification of bills in indonesia and the united states in order to identify similarities and differences as well as their relevance to strengthening indonesia’s constitutional system. the research employs a normative legal method with a comparative (descriptive–comparative) approach, based on secondary legal materials. the findings show that in both countries the president plays a role at the final stage of lawmaking; however, in indonesia the president acts as a partner of the house of representatives from the deliberation stage and does not possess post-approval veto power, as a bill remains valid even if it is not signed within 30 days. in contrast, in the united states the president exercises final control through the regular veto and the pocket veto, with the possibility of a congressional override in the case of a regular veto. this difference underscores distinct models of checks and balances: in the united states through the veto and override mechanism, and in indonesia through joint approval and judicial review by the constitutional court. in terms of relevance, to strengthen corrective control at the final stage of legislation on a partial basis limited to specific articles and/or paragraphs deemed contrary to national policy and urgency this study proposes the strengthening of a limited veto right for the president, the introduction of pre-enactment constitutional review, and improvements in the quality of the legislative drafting process.
