D Di indonesia, letter of credit atau l/c diatur oleh peraturan pemerintah no. 1 tahun 1982, dan peraturan anggota dewan gubernur no. 23/21/padg/2021, serta mengacu pada standar internasional uniform customs and practice 600. l/c memiliki dua prinsip pokok, yaitu prinsip independensi, dan prinsip keterikatan pada dokumen. meski aman, l/c dapat menimbulkan sengketa akibat kurangnya pemahaman, bahkan disalahgunakan seperti kasus pembobolan bank bni senilai rp1,2 triliun menggunakan 41 l/c fiktif. permasalahannya, yaitu bagaimana pengaturan prinsip independensi dan keterikatan pada dokumen l/c menurut ucp 600?, dan apakah penerapan kedua prinsip pada putusan nomor 22/pid.sus-tpk/2021/pt.dki sesuai peraturan perundang-undangan? penelitian ini mengunakan metode normatif, bersifat deskriptif, menggunakan data sekunder sebagai data utamanya, dianalisis secara kualitatif, dan penarikan kesimpulan secara deduktif. kesimpulan penelitian ini adalah prinsip independensi dalam ucp 600 menetapkan bahwa l/c terpisah dari kontrak dasar, dan bank hanya terikat pada kesesuaian dokumen tanpa mempertimbangkan kontrak tersebut; putusan nomor 22/pid.sus-tpk/2021/pt.dki menerapkan prinsip independensi, dan keterikatan l/c yang mewajibkan bank membayar berdasarkan kesesuaian dokumen tanpa mempertimbangkan kontrak dasar, namun tetap mengutamakan keadilan substantif, dan pemberantasan korupsi di atas formalitas prosedural dengan tidak memberikan imunitas pidana ketika l/c disalahgunakan untuk tujuan melawan hukum.
I In indonesia, letters of credit (l/c) are regulated by government regulation no. 1 of 1982 and regulation of the board of governors no. 23/21/padg/2021, and adhere to the international standard uniform customs and practice 600. l/cs have two main principles: independence and document binding. although secure, l/cs can lead to disputes due to a lack of understanding and even misuse, such as the case of the rp1.2 trillion embezzlement of bni bank using 41 fictitious l/cs. the question is: how are the principles of independence and document binding regulated by ucp 600? and does the application of these two principles in decision number 22/pid.sus-tpk/2021/pt.dki comply with statutory regulations? this research uses a normative, descriptive method, utilizes secondary data as its primary data, analyzes qualitatively, and draws conclusions deductively. the conclusion of this study is that the principle of independence in ucp 600 stipulates that the l/c is separate from the basic contract, and the bank is only bound by the conformity of the documents without considering the contract; decision number 22/pid.sus-tpk/2021/pt.dki applies the principle of independence, and the binding of the l/c requires the bank to pay based on the conformity of the documents without considering the basic contract, but still prioritizes substantive justice, and the eradication of corruption above procedural formalities by not providing criminal immunity when the l/c is misused for unlawful purposes.
