B Badan penyelenggara jaminan kesehatan in 2021 experienced a breach of personal data belonging to its participants, an incident that raised concerns about the protection of privacy rights. this incident constitutes a violation of privacy rights as stipulated in article 17 of the 1966 iccpr. this study consists of two research questions, namely the breach of personal data in the case of the 2021 bpjs kesehatan participant data breach as a violation of the right to privacy based on the 1966 iccpr and state protection measures to protect the right to privacy in the case of the bpjs kesehatan participant data breach based on indonesian laws and regulations. the writing method used is a deductive method with a normative type of research on the international legal instrument of article 17 of the 1966 iccpr, as well as a descriptive writing style using secondary data consisting of primary, secondary, and tertiary laws. the results of this study show that personal data breaches violate privacy rights, thereby triggering the state\\\'s obligation to protect privacy rights.
