T The development of digital comics, such as webtoons, has had a significant impact on the global creative industry, including in indonesia. on one hand, digitalization has made the distribution and access to creative works easier; on the other hand, it has also posed legal challenges, particularly regarding copyright infringement due to unauthorized translation and distribution practices (scanlation). translations carried out without official permission not only harm creators and translators but also undermine copyright protection for derivative works.the main issue addressed in this research is how the rights of digital comic translators are protected in indonesia and south korea, and whether the provisions in the south korean copyright act can be adopted into indonesian copyright practice. this research uses a normative legal method with a statutory and comparative approach. data were obtained through literature review of laws and regulations in indonesia and south korea, as well as interviews with parties involved in the digital comic industry.the findings indicate that digital comic translators, provided their work meets originality requirements, are entitled to protection as creators of derivative works under article 40 paragraph (1) letter l of the indonesian copyright law. however, the implementation in indonesia remains weak due to the lack of institutional support for exclusive copyright protection. conversely, south korea has established institutions—namely the korea copyright commission (kcc) and the korea copyright protection agency (kcpa)—which effectively support copyright protection. an independent institution is needed in indonesia to ensure optimal legal protection for translators in the digital comic industry, allowing for a system that is responsive and adaptable to the challenges of the digital era.the development of digital comics, such as webtoons, has had a significant impact on the global creative industry, including in indonesia. on one hand, digitalization has made the distribution and access to creative works easier; on the other hand, it has also posed legal challenges, particularly regarding copyright infringement due to unauthorized translation and distribution practices (scanlation). translations carried out without official permission not only harm creators and translators but also undermine copyright protection for derivative works.the main issue addressed in this research is how the rights of digital comic translators are protected in indonesia and south korea, and whether the provisions in the south korean copyright act can be adopted into indonesian copyright practice. this research uses a normative legal method with a statutory and comparative approach. data were obtained through literature review of laws and regulations in indonesia and south korea, as well as interviews with parties involved in the digital comic industry.the findings indicate that digital comic translators, provided their work meets originality requirements, are entitled to protection as creators of derivative works under article 40 paragraph (1) letter l of the indonesian copyright law. however, the implementation in indonesia remains weak due to the lack of institutional support for exclusive copyright protection. conversely, south korea has established institutions—namely the korea copyright commission (kcc) and the korea copyright protection agency (kcpa)—which effectively support copyright protection. an independent institution is needed in indonesia to ensure optimal legal protection for translators in the digital comic industry, allowing for a system that is responsive and adaptable to the challenges of the digital era.
