M Mediator hubungan industrial adalah asn pejabat fungsional nonmanajerial yang bertugas memfasilitasi penyelesaian perselisihanhubungan industrial secara netral. meskipun bagian dari eksekutif,tindakan mediator dapat diuji secara yudisial jika dianggap tidakprofesional. contoh kasus terkait hal ini terdapat dalam putusan nomor54/pdt.sus-phi/2023/pn.pbr, di mana seorang pekerja mengajukangugatan terhadap perusahaan dan kepala dinas tenaga kerja sebagaimediator karena merasa mediasi tidak dijalankan secara netral.penggugat menilai mediator menolak mediasi lanjutan yang sah,sehingga haknya terhambat. untuk itu, timbul permasalahan terkaitbagaimana pengaturan terhadap mediator hubungan industrial sebagaiasn pejabat eksekutif di dinas ketenagakerjaan diperbolehkanmenjalankan fungsi yudikatif dalam hubungan industrial dan akibathukum mediator yang ditarik menjadi turut tergugat di pengadilanhubungan industrial. penelitian ini menggunakan metode hukumnormatif, fokus pada sinkronisai hukum dan analisis hukum. hasilpenelitian menunjukkan bahwa mediator hubungan industrial tidakdapat bertindak sebagaimana fungsi yudikatif. selain itu, pihak yangmerasa dirugikan dapat mengajukan gugatan ke pengadilan hubunganindustrial. gugatan tersebut menegaskan bahwa tindakan mediatordapat diuji secara yudisial dan administratif, sehingga mediator harusmenjalankan kewenangan mediasi secara netral, proporsional, terbuka,dan profesional untuk menjaga kredibilitas dan integritas asn.

A An industrial relations mediator is a non-managerial civil servant (asn) whose job is to facilitate the resolution of industrial relations disputes in a neutral manner. although part of the executive branch, a mediator\\\'s actions can be subject to judicial review if deemed unprofessional. an example of this is decision number 54/pdt.sus-phi/2023/pn.pbr, in which a worker filed a lawsuit against the company and the head of the manpower office, acting as mediator, because he felt the mediation was not conducted impartially. the plaintiff alleged that the mediator refused to conduct legitimate follow-up mediation, thereby hindering his rights. therefore, issues arise regarding how industrial relations mediators, as asn executive officials in the manpower office, are permitted to exercise judicial functions in industrial relations and the legal consequences of mediators being named co-defendants in the industrial relations court. this research uses normative legal methods, focusing on legal synchronization and legal analysis. the research results show that industrial relations mediators cannot act in a judicial capacity. furthermore, any aggrieved party can file a lawsuit with the industrial relations court. the lawsuit emphasizes that a mediator\\\'s actions are subject to judicial and administrative review, and therefore, mediators must exercise their mediation authority neutrally, proportionally, openly, and professionally to maintain the credibility and integrity of civil servants.
