P Putusan mahkamah konstitusi nomor 112/puu-xx/2022 menimbulkan kontroversi karena mk menambahkan frasa \\\"atau berpengalaman sebagai pimpinan kpk\\\" pada syarat usia calon pimpinan kpk dan mengubah masa jabatan dari 4 tahun menjadi 5 tahun. tindakan mk tersebut dinilai telah melampaui kewenangannya sebagai negative legislator dan melanggar asas open legal policy. permasalahan yang timbul adalah bagaimana akibat hukum putusan mk nomor 112/puu-xx/2022 yang dinilai melampaui kewenangan (ultra vires) dan bertentangan dengan prinsip open legal policy, serta apakah putusan tersebut telah sesuai dengan peraturan perundangan-undangan yang berlaku. penelitian ini menggunakan tipe penelitian hukum normatif yang dipadukan dengan pendekatan empiris melalui wawancara dengan dosen hukum tata negara. sifat penelitian bersifat deskriptif-analitis dan penarikan kesimpulan dengan metode deduktif. berdasarkan hasil penelitian dan kesimpulan yaitu mk telah bertindak melampaui fungsinya sebagai negative legislator dengan menciptakan norma baru yang seharusnya menjadi kewenangan dpr dan presiden. akibat hukum yang ditimbulkan meliputi terjadinya pembentukan norma baru oleh mk (judicial law making), pelanggaran prinsip prospektif, inkonsistensi penerapan asas open legal policy, dan ketiadaan mekanisme checks and balances terhadap putusan mk. putusan ini tidak sesuai dengan pasal 73 ayat (1c) pmk nomor 2 tahun 2021 dan ketentuan konstitusional yang membatasi kewenangan mk dalam pengujian undang-undang.
C Constitutional court decision number 112/puu-xx/2022 sparked controversy because the constitutional court added the phrase \\\"or has experience as kpk leadership\\\" to the age requirements for kpk leadership candidates and extended the term of office from 4 years to 5 years. the constitutional court\\\'s action are considered to have exceeded its authority as an negative legislator and violated the principle of open legal policy. the problems that arise are how the legal consequences of constitutional court decision number 112/puu-xx/2022, which is deemed to have exceeded its authority (ultra vires) and contradicted the principle of open legal policy, and whether the decision is in accordance with the prevailing laws and regulations. this research uses a normative legal research type combined with an empirical approach through interviews with constitutional law lecturers. the nature of the research is descriptive-analytical and draws conclusions using a deductive method. based on the research findings and conclusions, the constitutional court has acted beyond its funcion as a negative legislator by creating new norms that should be the authority of the house of representatives and the president. the legal consequences include the formation of new norms by the constitutional court (judicial law-making), violation of the prospective principle. inconsistent application of the open legal policy principle, and the absence of a checks and balances mechanism over constitutional court decisions. this decision does not comply with article 73 paragraph (1c) of constitutional court regulation number 2 of 2021 and constitutional provisions that limit the constitutional court\\\'s authority in judicial review.
